1. INTERPRETATION
1.1 Definitions
In these Terms and Conditions:

• “Conditions” – these standard terms and conditions, including any written special terms agreed between us and you.

• “Consumer” – an individual hiring equipment for personal use, not connected with a trade or business.

• “Contract” – the agreement between you and E.T.A Loo’s for the hire of our equipment.

• “Equipment” – any portable toilets or related items supplied by us as specified in the Hire Contract.

• “Hire Charges” – the agreed price for hiring the equipment, including any transport or delivery costs, excluding VAT.

• “Hire Contract” – the document or written confirmation from us detailing the equipment, site, hire period, and charges.

• “Hire Period” – the duration of the hire, starting on delivery and ending when the equipment is collected or the contract is terminated.

• “Minimum Hire Period” – the minimum duration for which hire charges apply, as set out in the Hire Contract.

• “Order” – your request to hire our equipment, made verbally, in person, or in writing.

• “Site” – the agreed location for delivery and use of the equipment.

• “Working Day” – any day excluding weekends and public holidays.

• “We”, “Us”, “Our” – E.T.A Loo’s.

• “You”, “Your” – the person or organisation hiring the equipment.

2. CONDITIONS OF HIRE
2.1 We agree to hire and you agree to rent the equipment for the hire period subject to these Conditions, which take precedence over any other terms.
2.2 Any changes to these Conditions must be agreed in writing.
2.3 Marketing materials or brochures are for guidance only and are not part of the Contract.
2.4 Any typographical or clerical errors may be corrected without liability.
2.5 All quotations are subject to equipment availability.
2.6 If you are a Consumer, the hire period will not exceed three months.
2.7 We may make reasonable adjustments to the equipment specification or provide suitable alternatives if necessary.
2.8 You must not sub-let the equipment without our prior written consent.
2.9 You should inspect the equipment upon delivery and report any visible damage or defect within two working days.
3. ORDERS AND CANCELLATION
3.1 Your order is an offer to hire equipment in line with these Conditions.
3.2 The Contract becomes binding once we confirm in writing or deliver the equipment.
3.3 Either party may end the hire period by notifying the other before 4:00 PM on a working day.
3.4 We will aim to collect the equipment within three working days of the hire ending.
3.5 Delivery or collection times are estimates only.
3.6 Hire charges may be adjusted with 10 days’ written notice.
3.7 If you are a Consumer, you may cancel the contract within 14 days of signing and receive a refund (subject to clause 3.8).
3.8 If equipment has already been delivered, we will deduct delivery, collection, and hire costs from the refund.
3.9 Once accepted, orders cannot be cancelled without our written consent.
3.10 If the equipment fails through no fault of your own, you will receive a fair rebate for the affected period.

4. YOUR RESPONSIBILITIES
You agree to:

• Ensure the site is suitable for delivery and use (level ground, solid base, and vehicle access within 15 metres).

• Provide clear access between 07:30 and 16:30 for delivery, servicing, and collection.

• Ensure the equipment is located at street level for collection.

• Protect underground services from damage during delivery or collection.

• Prevent damage from frost or extreme weather.

• Avoid moving, modifying, or repairing the equipment without our written consent.

• Keep the equipment clean, secure, and available for collection at the end of hire.

• Treat our staff respectfully — abuse toward drivers or team members will result in cancellation of service and applicable charges.

Additional charges may apply if:

• Access is delayed, restricted, or unsuitable.

• Collection takes longer than 15 minutes per unit (charged at £60/hour + VAT in 15-minute increments).

• The equipment is returned dirty or damaged.

5. INSURANCE AND LIABILITY
5.1 You are responsible for the equipment from delivery until collection and must cover any damage or loss.
5.2 You agree to indemnify us against all claims, losses, or damages arising from use, misuse, or non-use of the equipment (except where caused by our negligence).
5.3 You must secure the equipment to prevent it from tipping or causing damage.
5.4 Report any accidents within 24 hours and provide all required information.
5.5 Any insurance claim proceeds related to the equipment must be held on trust for us.
5.6 Additional repair or cleaning costs will be charged if the equipment is returned in poor condition.
Non-returned, Lost, Stolen, Damaged, or Unclean Equipment Policy
The Hirer assumes full responsibility for the care, safekeeping, and timely return of all Equipment in good condition. In the event that any Equipment is returned damaged or unclean, the Hirer agrees to cover all costs incurred by the Supplier in restoring the Equipment to its original state. Additionally, the Hirer will be liable for a charge reflecting the financial loss suffered by the Supplier until such restoration is completed.
In cases of lost or stolen Equipment, or if the Equipment is damaged beyond economic repair, the Hirer acknowledges their liability for all financial losses incurred by the Supplier. This liability is in addition to any other rights the Supplier may have.


6. HIRE CHARGES AND PAYMENT
6.1 Hire charges must be paid as agreed in the Hire Contract.
6.2 If the hire ends before the minimum hire period, full charges still apply.
6.3 Unless agreed otherwise, we will invoice you before or during the hire period.
6.4 Payment is due within 28 days of invoice unless otherwise stated.
6.5 Delivery will not take place until any required advance payment has been received.
6.6 Late payments may incur:

• Interest at 4% above the Bank of England base rate, and

• Immediate suspension of service or collection of equipment.
  6.7 We may also charge reasonable administrative or recovery costs for dishonoured payments or defaults.

7. WARRANTIES AND LIABILITY
7.1 We will deliver equipment in good working order.
7.2 We are not liable for issues arising from late or missed payments.
7.3 Nothing in this contract limits liability for death, injury, fraud, or any matter that cannot legally be excluded.
For Consumers:

• We are responsible for losses caused by our failure to use reasonable care or skill.

• We are not responsible for unforeseeable losses or business-related losses.

For Business Customers:

• We are not liable for loss of profit, business, data, or indirect damage.

• Our total liability is limited to the total hire charges paid under this contract.

8. TERMINATION
We may cancel the contract or reclaim the equipment immediately if you:

• Fail to make payments on time;

• Breach these terms;

• Become insolvent, bankrupt, or cease trading.

If you experience issues with the equipment, please contact us within two working days so we can investigate or provide a replacement.
Consumers may reject faulty equipment within 30 days for a refund.

9. FORCE MAJEURE
Neither party is liable for delays or failures caused by events beyond reasonable control, such as strikes, extreme weather, or natural disasters.

11. GENERAL

• We may use subcontractors or agents to fulfil our obligations.

• Any waiver of rights must be in writing.

• If any clause is found invalid, the remainder of these Conditions will continue in effect.

• Consumer statutory rights are not affected.

• This Contract is governed by English law and subject to the jurisdiction of the English courts.

• We process personal data in accordance with our Privacy Policy, available on request or via our website.
